05.02.2024 – The EU placed various legislative proposals for European data regulation at the top of its priority agenda, meaning that the legal framework for data use and the application of AI will change significantly in the short and medium term.
In addition to the new regulations for the digital sector (Digital Services Act, Digital Governance Act, Digital Markets Act, etc.), which already came into force in 2023, the Artificial Intelligence Act (AI Act), which was widely anticipated and eyed with skepticism, has now also been adopted.
The AI Act is certainly not a prime example of successful legislation. However, it has now been passed and is binding – with rather short implementation deadlines. It is now important for companies and organizations to gain an overview of the relevant regulators and integrate the content of the regulation into their own compliance strategy.
The EU Data Act is also likely to be of paramount importance for every company. Under the Data Act, for example, all cloud customers have the right to switch providers at any time with a notice period of two months (Art. 25 para. 2 lit. d DA). The exact impact on the cloud remuneration owed is currently unclear.
The AI Act and Data Act naturally also contain numerous other regulations of practical relevance.
There are also important new laws in the areas of IT Security and Health Data protection, among others.
